ऐसी स्थिति में घबराकर bank officials से बहस करना या बिना records समझे कोई declaration sign कर देना सही पहला कदम नहीं है।
Karnataka High Court का महत्वपूर्ण कानूनी पहलू
Mohammed Aslam v. Punjab National Bank, W.P. No. 202457/2026, 6 July 2026 में Karnataka High Court के सामने account freeze और cybercrime-investigation communications का मुद्दा आया। Bank ने account पर लगी restriction हटाने के लिए required forms और banking formalities पूरी करने की बात कही। Court ने bank को निर्देश दिया कि petitioner द्वारा आवश्यक formalities पूरी करने पर account defreeze किया जाए।
इस order में Court ने Sri Madhu v. The Indus Bank Ltd., W.P. No. 38362/2025, dated 9 June 2026 के सिद्धांतों पर भी भरोसा किया। उस मामले में investigating agencies की communications कुल ₹25,000 तक के freeze से संबंधित थीं, लेकिन bank ने पूरा account रोक दिया था। Court ने स्पष्ट किया कि यदि competent authority ने केवल एक specified amount freeze करने को कहा है, तो bank सामान्यतः उस सीमा से आगे restriction नहीं बढ़ा सकता—जब तक कोई अन्य lawful direction या statutory requirement लागू न हो।
यह distinction महत्वपूर्ण है: किसी account पर genuine investigation चल रही हो, तो lawful freeze को चुनौती देने का अधिकार अपने-आप समाप्त नहीं होता; लेकिन इसका मतलब यह भी नहीं कि हर freeze गलत है या हर account तुरंत खुल जाएगा।
विदेश में बैठे NRI को क्या समझना चाहिए?
अगर आपका India में salary account, savings account, business account या investment-linked account cybercrime complaint के कारण restricted है, तो सबसे पहले bank से उपलब्ध complaint references, freeze instructions, affected amount और compliance requirements लिखित में माँगें। यह भी जाँचें कि restriction investigating agency ने कितनी राशि के लिए माँगी थी और bank ने वास्तव में कितनी राशि रोक रखी है।
NRI husband के लिए परेशानी तब और बढ़ सकती है जब matrimonial dispute, financial transaction या किसी third-party payment की वजह से account के बारे में सवाल उठने लगें। लेकिन हर bank freeze को false matrimonial case का परिणाम मान लेना भी सही नहीं होगा। पहले actual record सामने लाना जरूरी है।

कई महीनों तक account restriction बनी रहने पर family expenses, business payments और financial commitments प्रभावित हो सकते हैं। इसलिए bank से written clarification लेने, संबंधित authority के निर्देश समझने और जरूरत पड़ने पर appropriate legal remedy पर विचार करने में देरी न करें।
