20 August 2026 को Allahabad High Court ने क्या कहा?

Avika Saxena v. Union of India, Writ-C No. 8775 of 2026 में minor child की mother ने passport के लिए राहत मांगी। माता-पिता के बीच matrimonial dispute था और father की consent उपलब्ध नहीं थी। Court ने स्पष्ट किया कि prescribed procedure के तहत, जहां जरूरी declaration और verification पूरी हों तथा कोई prohibitory court order न हो, वहां केवल दूसरे parent की consent न मिलने से passport application अपने-आप रुकनी नहीं चाहिए। Court ने passport process पूरा करने का निर्देश दिया, subject to routine verification and no legal impediment.

इसका मतलब यह नहीं कि हर बच्चे को हर परिस्थिति में बिना consent passport मिल जाएगा। अगर custody order, travel restriction या child को दूसरे देश ले जाने से जुड़ा गंभीर विवाद है, तो facts और court directions महत्वपूर्ण होंगे।

सोचिए, आपने Court या Police को एक audio recording, video clip या screenshot दिया। वह देखने-सुनने में बिल्कुल असली लगता है। लेकिन अगर उसमें AI से आवाज़, चेहरा, शब्द या context बदला गया हो, तो आपकी पूरी complaint की credibility पर सवाल उठ सकते हैं।

आजकल technology से किसी की आवाज़ की नकल करना, video में चेहरा बदलना और ऐसी clips बनाना आसान होता जा रहा है जो पहली नजर में genuine लग सकती हैं।

लेकिन legal proceedings में सबसे जरूरी सवाल यह नहीं है कि कोई recording असली जैसी दिखती है।

सवाल है: क्या वह वास्तव में authentic है?

Fake Evidence का खतरा केवल सामने वाले पक्ष तक सीमित नहीं है

मान लीजिए किसी matrimonial dispute में एक audio clip सामने आती है। उसमें ऐसा लगता है कि किसी व्यक्ति ने धमकी दी, कोई बात स्वीकार की या कोई गलत काम करने की बात कही।

या property dispute में कोई video पेश कर दिया जाता है जिसमें किसी व्यक्ति को ऐसा कहते या करते दिखाया जाता है जो वास्तव में हुआ ही नहीं।

अगर ऐसी material बिना proper verification के complaint, reply या court filing में डाल दी गई, तो मामला केवल उस clip की truthfulness तक सीमित नहीं रहेगा। उसकी authenticity, source और reliability भी सवालों के घेरे में आ सकती है।

और अगर आपने खुद genuine evidence के बजाय manipulated material पर भरोसा कर लिया, तो आप अनजाने में अपने ही case को कमजोर कर सकते हैं।

Courts भी AI-generated evidence को लेकर सावधानी पर जोर दे रहे हैं

Supreme Court के 2026 draft AI-in-Courts framework में कहा गया है कि AI-generated output को independent source of evidence के रूप में Court में पेश नहीं किया जाना चाहिए, जब तक उसके AI-generated character का full and transparent disclosure न हो। यह framework draft है; इसे हर परिस्थिति पर लागू होने वाला blanket ban समझना सही नहीं होगा। citeturn560524search27

Delhi High Court ने भी AI-generated deepfake videos, morphed images और fabricated audiovisual content से जुड़े मामलों में relief पर विचार किया है। ऐसे मामलों में व्यक्ति की identity, reputation और image के misuse के गंभीर सवाल उठे हैं। citeturn560524search2turn560524search28

इसलिए एक बात स्पष्ट है:

जो चीज़ screen पर दिखाई देती है, वह अपने-आप genuine evidence नहीं बन जाती।

Party-in-Person हों या Advocate — ये सवाल जरूर पूछें

• Recording या screenshot सबसे पहले कहाँ से आया?
• क्या original file उपलब्ध है या केवल forwarded copy है?
• क्या file edit, crop, enhance या convert की गई है?
• क्या पूरी conversation उपलब्ध है या सिर्फ कुछ seconds का clip?
• क्या original device और surrounding context सुरक्षित हैं?
• क्या authenticity पर सवाल उठने पर independent technical examination की जरूरत पड़ सकती है?

केवल AI detector या किसी chatbot के answer पर भी final भरोसा मत कीजिए। ऐसे tools गलत नतीजे दे सकते हैं। Evidence की authenticity का assessment पूरे context और उपलब्ध technical material के आधार पर होना चाहिए।

एक छोटी-सी shortcut आपकी credibility पर सवाल खड़े कर सकती है

AI से किसी recording को साफ करना, transcript बनाना या audio समझने में मदद लेना और किसी recording को बदलकर उसे genuine evidence की तरह पेश करना — ये अलग-अलग बातें हैं।

अगर किसी file को enhance या convert किया गया है, तो original सुरक्षित रखें और किए गए बदलावों का record रखें। अगर content AI-generated या manipulated है, तो उसकी nature छिपाकर उसे authentic original की तरह पेश न करें।

आपकी complaint में सच होना जरूरी है; केवल convincing दिखाई देना काफी नहीं है।

आपकी Complaint में असली problem क्या है, यह सबसे important है। लेकिन अगर AI ने आपकी कहानी को इतना बदल दिया कि Court या Police को आपकी बात समझ ही न आए, तो नुकसान कहाँ से शुरू होगा?

आजकल Party-in-Person हो या Advocate, AI से drafting करना आसान हो गया है।

आप facts बताइए।

AI paragraphs बना देगा।

आप documents डालिए।

AI legal language बना देगा।

आप police complaint दीजिए।

AI उसे “professional” बनाने की कोशिश कर देगा।

लेकिन legal case कोई school essay नहीं है।

एक court pleading का काम impressive English लिखना नहीं — आपकी वास्तविक facts, allegations, evidence और relief को बिल्कुल साफ तरीके से सामने रखना है।

और यहीं AI का एक नया danger सामने आया है।

Delhi Court में AI-style drafting पर ₹20,000 की cost

30 March 2026 को Rouse Avenue Court में एक FIR-related application पर Additional Chief Judicial Magistrate Neha Mittal ने drafting की quality पर गंभीर आपत्ति जताई।

Application में grammatical mistakes के साथ ऐसे random और meaningless words थे कि Court को यह समझने में भी कठिनाई हुई कि applicant वास्तव में कहना क्या चाहती है।

Court ने टिप्पणी की कि drafting में “more technical intervention and less of human mind contribution” दिखाई देता है और ऐसी drafting ने judicial time waste किया। Application dismiss की गई और ₹20,000 की cost लगाई गई, जो Delhi Legal Services Authority में जमा होनी थी।

अब अपने case के बारे में सोचिए।

अगर आपकी police complaint में आपकी असली कहानी ही साफ नहीं है, तो आपकी सबसे important बात कहाँ दिखाई देगी?

अगर matrimonial dispute है — chronology बिगड़ सकती है।

अगर property dispute है — transaction की sequence अस्पष्ट हो सकती है।

अगर police complaint है — कौन, कब, कहाँ, क्या हुआ और किस evidence से साबित होगा, यह ठीक से सामने नहीं आ सकता।

अगर court case है — आपका actual grievance unnecessary legal language के नीचे दब सकता है।

और फिर आप सोचते रहेंगे:

“मैंने तो सारी बात बताई थी। फिर Court ने मेरी बात समझी क्यों नहीं?”

यही AI shortcut का danger है।

AI आपकी भाषा सुधार सकता है — आपकी पूरी कहानी नहीं समझ सकता

AI को पता नहीं कि आपके लिए कौन-सा fact सबसे महत्वपूर्ण है जब तक human legal understanding उसे सही context न दे।

AI को यह भी नहीं मालूम कि आपकी file में कौन-सा document वास्तव में disputed है, कौन-सा fact admission बन सकता है और कौन-सी बात आपके अपने case को नुकसान पहुँचा सकती है।

वह एक polished paragraph बना सकता है।

लेकिन polished paragraph और legally useful pleading एक ही चीज नहीं हैं।

इसलिए किसी Advocate ने AI इस्तेमाल किया है तो केवल यह मत पूछिए:

“Draft अच्छा लग रहा है?”

पूछिए:

“क्या इसमें मेरी actual story exactly सही है?”

“क्या chronology सही है?”

“क्या कोई fact बदल गया है?”

“क्या कोई important fact छूट गया है?”

“क्या कोई ऐसा allegation जोड़ दिया गया है जो मैंने कभी कहा ही नहीं?”

“क्या filing से पहले किसी इंसान ने पूरा document line-by-line पढ़ा है?”

ये सवाल आपकी life, career, finances, relationship और reputation से जुड़े हो सकते हैं।

“AI ने बनाया था” Court में magic excuse नहीं है

यही बात सबसे ज्यादा याद रखिए।

AI ने गलती की।

AI ने sentence बिगाड़ दिया।

AI ने context बदल दिया।

AI ने unnecessary material जोड़ दिया।

AI ने translation खराब कर दी।

AI ने facts को गलत समझ लिया।

इनमें से कोई भी बात आपके लिए automatically safe exit नहीं बन जाती।

Final document इंसान Court में देता है।

इसलिए Party-in-Person हो या Advocate — human verification सबसे जरूरी layer है।

Supreme Court ने भी AI-generated material के संदर्भ में human responsibility और verification की जरूरत पर कड़ा रुख अपनाया है। 2 July 2026 के Pooja Ramesh Singh decision में Supreme Court ने fake/hallucinated AI-generated precedents के unverified use के प्रति zero-tolerance approach अपनाई और कहा कि legitimate AI use पर रोक नहीं है; समस्या तब है जब गलत या fabricated material को genuine legal material की तरह पेश किया जाए।

इसलिए message यह नहीं है कि “हर AI use गलत है।”

Message इससे ज्यादा practical है:

AI को इस्तेमाल करने वाला इंसान अगर खुद verify नहीं करता, तो technology case की मदद करने के बजाय case की presentation बिगाड़ सकती है।

अपने Court Case को AI-Drafting Disaster से कैसे बचाएं?

अपने facts खुद समझिए।

Original documents संभालकर रखिए।

Chronology अलग से तैयार रखिए।

Final complaint या pleading को filing से पहले पूरा पढ़िए।

हर paragraph पूछिए:

“क्या यह मेरी बात है?”

अगर नहीं — हटाइए।

अगर language impressive है लेकिन meaning unclear है — दोबारा लिखिए।

अगर AI ने कोई legal proposition दिया है — independently verify कीजिए।

और अगर Advocate AI-assisted drafting कर रहा है, तो human review और final responsibility के बारे में सवाल पूछना बिल्कुल unreasonable नहीं है।

अगर आपको doubt है कि आपकी complaint, petition या court filing AI-assisted drafting के कारण facts, chronology या allegations में बदल गई है, तो filing आगे बढ़ाने से पहले document की human review कराइए।

AI को tool रखिए।

अपने case की कहानी इंसान से verify कराइए।

और जब मामला आपकी reputation, family, property, money या future का हो—

“चलता है” वाली drafting पर risk मत लीजिए।

आपके case में एक गलत sentence सिर्फ गलती हो सकता है। लेकिन एक fake judgment, fake citation या AI से बना हुआ nonexistent precedent आपके पूरे legal argument को हिला सकता है।

आजकल Party-in-Person हो या Advocate, AI से research, drafting और legal language तैयार करना आसान हो गया है।

लेकिन court में सबसे बड़ा सवाल यह नहीं है कि draft कितना impressive दिखता है।

सवाल है:

क्या उसमें लिखा हुआ हर judgment वास्तव में मौजूद है?

क्या cited paragraph उसी judgment में है?

क्या वह judgment वही legal principle बताता है जो filing में लिखा गया है?

और क्या उस judgment का ratio आपके facts पर वास्तव में लागू भी होता है?

यहीं AI की सबसे dangerous problem सामने आती है।

AI confident होकर गलत भी लिख सकता है।

और अगर इंसान ने उसे verify किए बिना filing में डाल दिया, तो गलती machine की नहीं रह जाती — उसका असर आपके case पर पड़ सकता है।

Supreme Court ने अब इस danger को बहुत स्पष्ट कर दिया है

2 July 2026 को Supreme Court ने Pooja Ramesh Singh v. Jammu & Kashmir Bank Ltd. में पाया कि NCLT और NCLAT के proceedings में ऐसे citations आए जो या तो अस्तित्व में ही नहीं थे, या genuine judgments को ऐसे paragraphs के साथ quote किया गया जो उन judgments में थे ही नहीं। Supreme Court ने उस decision-making process को set aside कर दिया।

Court ने कहा कि unverified AI-generated precedents को produce, cite या rely करने के प्रति zero tolerance होना चाहिए और किसी advocate द्वारा ऐसे judgments को verification के बिना cite करना misconduct है। Court ने यह भी स्पष्ट किया कि responsible use of AI itself prohibited नहीं है।

अब इससे भी बड़ा warning signal 2 September 2026 को सामने आया।

Vijay Ghanshyam Gadiya v. Union of India में Supreme Court ने पाया कि जिस order में ₹425.27 करोड़ से अधिक का customs penalty लगाया गया था, उसमें cited authorities में non-existent cases, fake citations और ऐसे वास्तविक cases भी थे जिनमें वह legal proposition नहीं था जो order में उनसे निकाला गया था। Supreme Court ने उस order और उसे uphold करने वाले High Court order को set aside कर दिया और matter को fresh decision के लिए भेज दिया।

और Court की warning बहुत महत्वपूर्ण है:

AI assistance हो सकती है; adjudication का substitute नहीं।

Court ने साफ कहा कि AI को assistance के लिए इस्तेमाल किया जा सकता है, लेकिन उसे decision-making की “pilot seat” देना dangerous है।

अब अपने Advocate से भी एक simple सवाल पूछिए

“आपने जो judgments मेरे case में लगाए हैं, क्या आपने उन्हें personally verify किया है?”

सिर्फ citation देखकर संतुष्ट मत हो जाइए।

Judgment खोलिए।

Case number देखिए।

Date देखिए।

Actual paragraph पढ़िए।

देखिए कि quoted proposition वास्तव में उसी case में है या नहीं।

क्योंकि एक AI-generated fake citation आपके सामने वाले पक्ष को आपके पूरे argument की credibility पर सवाल उठाने का मौका दे सकती है।

और अगर आप Party-in-Person हैं, तो सिर्फ इसलिए AI output को सही मत मानिए क्योंकि language बहुत professional दिखाई देती है।

Legal English और legal correctness दो अलग चीजें हैं।

AI एक शानदार drafting assistant हो सकता है।

लेकिन वह आपके facts का witness नहीं है।

वह आपकी file का human reader नहीं है।

वह court में आपकी responsibility नहीं लेता।

और वह गलत citation के परिणाम भुगतने के लिए आपके साथ courtroom में खड़ा नहीं होगा।

Court Case में AI Disaster से कैसे बचें?

हर AI-assisted draft को final legal authority मत समझिए।

हर judgment independently verify कीजिए।

हर citation का original source देखिए।

Facts, ratio, paragraph और applicability अलग-अलग check कीजिए।

और सबसे महत्वपूर्ण—

AI से बनी हुई चीज को filing से पहले human legal scrutiny से गुजारिए।

Supreme Court का message AI को पूरी तरह बंद करना नहीं है।

Message इससे कहीं ज्यादा practical है:

Artificial Intelligence को Actual Intelligence का replacement मत बनाइए।

The Delhi High Court, in Ramandeep Kaur v. Harsh Oberoi & Ors., decided on 1 July 2026, dealt with a serious privacy issue in matrimonial litigation.

The case arose after intimate photographs of the wife were annexed to a divorce petition before the Family Court, Tis Hazari, Delhi. The photographs were stated to have formed part of a WhatsApp communication and were placed on the court record without redaction and without a sealed cover.

The High Court referred to earlier directions specifically concerning private material in matrimonial and custody disputes.

Those directions cover much more than photographs.

They include private letters, emails, text messages, WhatsApp chats, video clips, CCTV footage and other electronic material of a sensitive or personal nature.

And here's the part husbands should understand carefully.

The Court did not say that private material can never be relevant in matrimonial litigation.

Instead, where sensitive material is sought to be relied upon, the Court emphasised safeguards such as seeking permission, using a sealed cover, appropriate redaction and protecting confidentiality.

The Family Court can also control who gets access to such material and how copies are made, preserved or disclosed.

In the particular case, the High Court ultimately directed that the disputed photographs/documents be removed from the open record and placed in a sealed cover, with access restricted by court orders. It also directed protection of the petitioner's identity and restrained publication, circulation, reproduction, uploading or forwarding of the material.

This creates a completely different practical lesson for someone involved in a Delhi matrimonial dispute, CAW Cell Delhi matter, DV proceeding or divorce case.
