मान लीजिए आपने अपने matrimonial dispute, property dispute, police complaint या court case में Advocate को पूरी कहानी बताई। आपने documents दिए, weaknesses बताईं, settlement discussions कीं और अपनी personal strategy तक share कर दी।
फिर बाद में पता चले कि वही Advocate किसी connected matter में opposite side के लिए appear कर रहा है।
यहीं रुककर सोचिए।
आपने जो बात अपने Advocate को protection के लिए बताई थी, वही information अगर conflict वाली situation में सामने वाले पक्ष के हित से जुड़ जाए तो आपका trust, strategy और legal position कितना प्रभावित हो सकता है?
यह केवल डर पैदा करने वाली बात नहीं है। Delhi High Court के Legal Practitioners rules में ऐसी situations specifically addressed हैं। जहाँ Advocate ने पहले दूसरे party को case के संबंध में advise किया हो और उस confidence या existing retainer के कारण बाद में duty निभाने में conflict हो सकता हो, rules ऐसे retainer को refuse करने की बात करते हैं।
इसलिए केवल यह पूछना काफी नहीं है:
“Advocate experienced है या नहीं?”
यह भी पूछिए:
“क्या इस matter में कोई conflict of interest तो नहीं?”
क्योंकि court case में नुकसान केवल adverse judgment से नहीं होता। कभी confidential strategy, documents, negotiation position, property information, family details या financial information की गलत handling भी आपकी career, finances, relationship और reputation पर असर डाल सकती है।
और सबसे बड़ी गलती?
Conflict का पता बहुत देर से चलना।

आपकी life, career, finances, relationship और reputation केवल एक case number नहीं हैं।
