A matrimonial dispute can become extremely ugly when private photographs, WhatsApp chats, videos, emails or intimate documents enter the case file.

But there is an important question many husbands and their lawyers may not think about:

क्या हर private photograph को simply divorce petition या court file में annex कर देना सही है?

The Delhi High Court, in Ramandeep Kaur v. Harsh Oberoi & Ors., decided on 1 July 2026, dealt with a serious privacy issue in matrimonial litigation.

The case arose after intimate photographs of the wife were annexed to a divorce petition before the Family Court, Tis Hazari, Delhi. The photographs were stated to have formed part of a WhatsApp communication and were placed on the court record without redaction and without a sealed cover.

The High Court referred to earlier directions specifically concerning private material in matrimonial and custody disputes.

Those directions cover much more than photographs.

They include private letters, emails, text messages, WhatsApp chats, video clips, CCTV footage and other electronic material of a sensitive or personal nature.

And here's the part husbands should understand carefully.

The Court did not say that private material can never be relevant in matrimonial litigation.

Instead, where sensitive material is sought to be relied upon, the Court emphasised safeguards such as seeking permission, using a sealed cover, appropriate redaction and protecting confidentiality.

The Family Court can also control who gets access to such material and how copies are made, preserved or disclosed.

In the particular case, the High Court ultimately directed that the disputed photographs/documents be removed from the open record and placed in a sealed cover, with access restricted by court orders. It also directed protection of the petitioner's identity and restrained publication, circulation, reproduction, uploading or forwarding of the material.

This creates a completely different practical lesson for someone involved in a Delhi matrimonial dispute, CAW Cell Delhi matter, DV proceeding or divorce case.

Suppose you have:

WhatsApp chats.
Private photographs.
Voice recordings.
Videos.
Emails.
CCTV footage.
Personal medical material.

Don't assume:

“मेरे पास evidence है, इसलिए मैं उसे कहीं भी लगा सकता हूँ.”

Evidence can have relevance, admissibility and privacy/confidentiality issues at the same time.

And there is another warning in this judgment.

The Court noted that even the wife had placed certain photographs and videos of the husband in the litigation to portray him negatively. The Court said the broader principle applies to both sides: matrimonial litigation should not deteriorate into mutual humiliation through private or intimate material.

So if you are a husband collecting evidence for a CAW Cell Nanakpura, Crime (Women) Cell Delhi, 498A/406, DV or divorce matter, don't forward sensitive material casually to relatives, WhatsApp groups or social media.

पहले evidence preserve करो. फिर उसके lawful use की strategy समझो.

A screenshot may be useful.

A complete chat may be more useful.

The original phone may matter.

Metadata may matter.

And the manner in which the material is produced before the court may matter too.

Evidence को बचाना और evidence को circulate करना — दोनों बिल्कुल अलग चीजें हैं.

If you are already involved in a matrimonial dispute, don't wait until a private photograph, chat or video has been copied across multiple places before thinking about confidentiality.
